Brett Olsen

Brett Olsen is a graduate of the University of Florida (B.A., 1990), the University of New Mexico (M.A., 1994), and the University of New Mexico School of Law (J.D., cum laude, 1998).

After graduating from law school in 1998, Mr. Olsen spent six years working for the New Mexico firms of Montgomery & Andrews and Modrall Sperling, practicing in the areas of natural resources, real estate, commercial litigation and insurance defense litigation. He started a solo practice 2004 and was a shareholder in the Albuquerque firm of Olsen, Parden & Williams, P.C., prior to joining Abramowitz, Franks & Olsen in 2014. He is licensed to practice law in Colorado and New Mexico.


Mr. Olsen has represented a diverse group of private sector clients in commercial and tort litigation, water rights and mine permitting, natural resources and land use litigation, commercial transactions, real property and mineral leasing matters. He currently represents mostly public sector clients in water rights and other natural resources matters, constitutional litigation, and real estate transactions.

Mr. Olsen’s water law experience includes all aspects of practice before the New Mexico State Engineer. Since 2008, he has served as a Special Assistant Attorney General representing the State of New Mexico and the State Engineer in stream system adjudications, constitutional cases, and other litigation pertaining to water rights. He has also represented the Cebolleta Land Grant in litigation and transactional matters related to water rights, mineral leasing and reclamation, cultural properties, and real estate.

While his practice is largely concentrated in natural resources law, Mr. Olsen has broad litigation experience in a number of other areas including commercial and banking litigation, administrative law, contract disputes, personal injury, construction defect, oil and gas, multi-state class actions, and insurance law. This general litigation experience serves him well in litigating water and other natural resource cases. While the substantive issues may differ, experience in complex litigation has provided Mr. Olsen with extensive research, briefing, strategy, oral argument, deposition and cross examination skills, all of which are necessary to building and presenting a solid litigation case.


Mr. Olsen and his wife Katherine Olsen moved with their two boys to Fort Collins, Colorado from Albuquerque, New Mexico in 2013. He enjoys fly fishing, rock climbing, hiking and mountain biking with his family. He is also a musician and has played drums in bands since he was a teenager.
